Annual Percentage Rate (APR) for Purchases

Penalty APR and When it Applies

Up to 30.24%, based on your creditworthiness.

This APR may be applied to your account if you:

  1. Make a late payment;
  2. Go over your credit limit;
  3. Make a payment that is returned; or
  4. Do any of the above on another account you have with us.

This APR will vary with the market based on the Prime Rate.

How Long Will the Penalty APR Apply? If your APRs are increased for any of these reasons, the Penalty APR will no longer apply to existing balances if you make the next 6 consecutive payments when due. The Penalty APR will apply to other balances indefinitely.

How to Avoid Paying Interest on Purchases

Your due date is at least 23 days after the close of each billing cycle. We will not charge you interest on purchases if you pay your entire balance by the due date each month.

Minimum Interest Charge

If you are charged interest, the charge will be no less than $2.00

I understand that after my account is opened, the terms of my account are subject to change as provided in the Cardmember Agreement. I agree that if I am not approved for a World account that I may be approved for a Platinum account.

About Us and This Credit Card Program: This credit card program is issued and administered by Barclays Bank Delaware, located in Wilmington, Delaware. Changes to Account and Benefits Terms: We reserve the right to change the APR and other account terms in accordance with the Cardmember Agreement, Delaware law and the Federal Truth in Lending Act. We also reserve the right to change the benefits and features associated with the card or the account.

About Your Credit Report and Your Credit Performance: You agree that Barclays has the right to obtain a current credit report in connection with our review of your application and, subsequently, in connection with a requested charge to any account with us, the renewal of your account, or a change in your credit line; and that we have the right to report to others our credit experience with you. Upon your request, we will tell you the name and address of each consumer reporting agency from which we obtained a consumer report about you. After your account is opened, we will periodically review your credit performance. If you do not maintain your credit performance, we may change your account terms.

How the Variable APRs on Your Account will be Determined: The APRs on your account will be determined each billing cycle by adding a margin to the Prime Rate (which will be the highest rate published in the Money Rates column of The Wall Street Journal on the last business day of each month). See your Cardmember Agreement for more detail. The APRs noted above are current as of 06/24/2010 using a Prime Rate of 3.25%.

Important Information About Procedures for Opening a New Account: To help the government fight the funding of terrorism and money laundering activities, Federal law requires all financial institutions to obtain, verify, and record information that identifies each person who opens an account. What this means to you: When you apply for an account, we will ask for your name, street address, date of birth, social security number, and other information that will allow us to identify you. We may also ask to see copies of identifying documents.

Notice to Married Wisconsin Residents: No provision of any marital property agreement, unilateral statement under Section 766.59 of the Wisconsin statutes, or court order under Section 766.70 adversely affects the interest of the creditor, Barclays Bank Delaware, unless the Bank, prior to the time the credit is granted or an open-end credit plan is entered into, is furnished a copy of the Agreement, Statement or Decree, or has actual knowledge of the adverse provision. Balance Transfers. Here's How it Works:
To request a balance transfer please enter the 15 or 16 digit account number from the MasterCard, Visa, American Express, or Discover Card account that you want us to process a balance transfer to. Upon approval of your application we will provide you with your Cardmember Agreement and to the extent permitted by your credit line we will process the requested balance transfer payment to the credit card account(s) which you have requested. If the total amount you request exceeds the assigned credit line on this account, we may either decline the request or send a partial payment to your creditor(s) in the order you provided them to us. The amount of available credit on this account will be reduced by the amount of the balance transfer and the related balance transfer fees. We reserve the right to decline to process any requested balance transfer. We will not process a request to transfer a balance from any other account you may have with us. Balance transfers incur interest from the transaction date and they do not have the same charge back rights as transactions conducted with a credit card.

A balance transfer may take up to 4 weeks to post to your other credit card accounts. Continue to pay each creditor until the balance transfer appears on the other account as a credit. If you would like to complete a balance transfer from another account that is not a Visa, MasterCard, American Express, or Discover card, please call the phone number on the back of your new credit card once you are approved.

Important information about the EmigrantDirect Rewards Program
(a) EmigrantDirect credit card account holders residing in the U.S. (excluding Puerto Rico) are eligible to participate in the EmigrantDirect American Dream Credit Card Rewards Program ("Rewards Program") whereby participants will be awarded cash rebates based upon each use of their EmigrantDirect Rewards Credit Card issued by Barclays Bank Delaware for net retail purchase transactions. The cash rebates awarded will be even greater when the primary cardholder on an EmigrantDirect Rewards Credit Card (the "Card Account") maintains the required Average Daily Balance with EmigrantDirect in an American Dream Savings Account(s) that has that primary cardholder from the Card Account listed as the primary legal account owner of the applicable EmigrantDirect American Dream Savings Account(s) (the "Savings Account"). The cash rebates earned under the Rewards Program will be deposited automatically into the primary cardholder's designated Savings Account or in the event the primary cardholder does not have a Savings Account, posted as a statement credit on their Card Account. Please allow 6 to 8 weeks after the opening of any new Savings Accounts to have these accounts included in the Rewards Program.

(b) Approximately every six months beginning after your new Card Account is opened, a review of your Card Account and Savings Account(s) will be conducted (each a "Review Period"). If you are the primary cardholder on the Card Account and your Card Account is open and current on the statement closing date of the sixth billing cycle of the Review Period, you will be eligible for a cash rebate of: (1) 1.40% of Net Purchases posted to your Card Account in the last six (6) billing cycles, if you have maintained an Average Daily Balance over the last six (6) full calendar months of at least ten thousand dollars ($10,000) with EmigrantDirect held specifically in Savings Accounts in which you are the primary legal account owner; or (2) 0.50% of Net Purchases posted to your Card Account in the last six (6) billing cycles, if you have maintained an Average Daily Balance over the last six (6) full calendar months of less than ten thousand dollars ($10,000) with EmigrantDirect held specifically in Savings Accounts in which you are the primary legal account owner; or (3) 0.50% of Net Purchases posted to your Card Account in the last six (6) billing cycles, if you are not the primary legal account owner of a Savings Account. PLEASE NOTE THAT ONLY BALANCES HELD IN SAVINGS ACCOUNTS LISTING THE PRIMARY CARDHOLDER ON THE CARD ACCOUNT AS THE PRIMARY LEGAL ACCOUNT OWNER WILL BE COUNTED TOWARDS YOUR AVERAGE DAILY BALANCE. If your Card Account is not open and current on the sixth billing cycle of the Review Period you will not receive any cash rewards for that entire Review Period.

(c) After the review described in Section (b) above has been conducted, Barclays Bank Delaware will report to EmigrantDirect the cash back rewards you are eligible for in each applicable Review Period and request that EmigrantDirect deposit that cash back reward amount into your designated Savings Account. If you do not have a Savings Account or if your Savings Account is legally closed, your cash rebate will be credited to your Card Account, and will appear as a statement credit. You will not be eligible to receive a statement credit on your Card Account if you have a Savings Account that is open. Barclays Bank Delawareis not responsible for the depositing of your cash back reward to any Savings Account or for any delay, failure, or refusal by EmigrantDirect to award or deposit the cash back into your Savings Account or any other savings account at EmigrantDirect or for any decision by EmigrantDirect to revoke or cancel your participation or any of your Savings Accounts' participation in the Rewards Program.

(d) "Net Purchases" are determined by totaling all new Purchases added to the Card Account during the billing cycle, and then subtracting credits posted to the Card Account during the period for returned Purchases and/or adjustments. Net Purchases do not include fees, charges, credit insurance premiums, or transactions posting as Cash Advances, Convenience Checks or Balance Transfers. For purposes of calculating Net Purchases, we may round up or down to whole dollar amounts. Each month your Card Account statement will include the amount of potential cash back rewards that you may be eligible for in that billing cycle based on the Net Purchases reflected in our records at that time. We reserve the right to limit the number of authorized users on your Card Account at any time, currently you may only have three (3). Your Card Account may only be used for personal, family, or household purposes. Your Card Account may not be used for business or commercial purposes. Please note that Barclays Bank Delaware is unable to change your account billing cycle or your payment due date on your Card Account. If your Card Account is not open and current on the date a billing cycle closes, we may at our option calculate no Net Purchases for that billing cycle.

(e) The "Average Daily Balance" is calculated by: (1) calculating a combined daily balance for each business day in the Review Period on all Savings Accounts in which the primary cardholder on the Card Account is also the primary legal owner on the Savings Accounts (regardless of whether you had the particular Savings Account opened for the full six (6) calendar months); (2) adding all the daily balances together; and (3) dividing the sum of the combined daily balances by the number of business days in the applicable the six (6) calendar month Review Period. A daily balance will be treated as zero if the daily balance is less than zero or if the Savings Account was not legally open on a particular day. If the primary cardholder on the Card Account is not the primary legal owner of a Savings Account, that Savings Account will not be counted towards the Average Daily Balance calculation. EmigrantDirect will select one of the primary cardholder's open Savings Account as the specific account into which the cash rewards will be deposited unless the primary cardholder selects a specific individual Savings Account in the event the primary cardholder has multiple Savings Accounts.

(f) If you do not keep your Card Account open and current, your enrollment in the Reward Program may be canceled and/or any accrued cash back rewards may be forfeited. If any cash back you received was awarded based on Purchases not authorized by you, or if credits for returned Purchases from a previous Review Period post in any subsequent Review Period and such returned Purchases exceed the new Purchases in the applicable Review Period, Barclays Bank Delaware may at its option either report negative Net Purchases and ask EmigrantDirect to reduce your Savings Account accordingly, or may assess your Card Account for such amount(s). If your Card Account is sixty (60) or more days past due at any time, Barclays Bank Delaware may at its option assess your Card Account for any cash back rewards previously paid to you.

(g) All rewards deposited into your Savings Account are subject to the terms and conditions of your EmigrantDirect product regulations. The terms of this Rewards Program, including conditions of participation and redemption levels for cash back rewards, may be changed, added or deleted at any time, in whole or in part, without notice to you. Barclays Bank Delaware reserve the right to change or terminate, limit, modify, or cancel the Reward Program at any time. You are responsible for any taxes that may be due on the cash back rewards you receive. Neither Emigrant Bank nor any affiliate of Emigrant Bank are parties to the Cardmember Agreement between you and Barclays Bank Delaware, do not participate in any extension of credit or decision to extend credit under these regulations, and do not have authority regarding the Card Account. Barclays Bank Delaware is the sole creditor and owner of the Card Account. Barclays Bank Delaware is not responsible for, and has no authority regarding the Savings Account(s) or any other account at Emigrant Bank or any affiliate of Emigrant Bank.

You authorize Barclays Bank Delaware to share information about your Card Account with Emigrant Bank and any affiliate of Emigrant Bank to the extent needed to enroll you in and/ or administer the Reward Program. You also agree that Barclays Bank Delaware may share Card Account information as set forth in Barclays Bank Delaware's Privacy Policy.
